General working agreement
This document defines the terms and conditions of a working relationship for all projects or services delivered by JCS Internet Solutions (Executive Web Design and Cloud Networking) our Representatives and the individual or entity who is applying or using our Services.
The Terms may be updated from time to time. The client is responsible for visiting our web site on a regular basis so that the client may be made aware of any changes in this policy.
Use of JCS Internet Solutions services constitutes acceptance of the terms and conditions contained in this agreement and any amendments thereto.
INFORMATION AND MATERIALS
THE CLIENT warrants that all the information that is submitted is true and correct.
THE CLIENT warrants that he has all rights necessary to lawfully submit any information or materials that he is passing on to JCS Internet Solutions, this includes all intellectual property rights.
THE CLIENT agrees to indemnify JCS Internet Solutions against actions brought by a third party as a result of such material or information.
THE CLIENT acknowledges that we do not regulate or take any responsibility for the content or security of his website or email.
THE CLIENT warrants that unsolicited email (Known as spam) is not permitted.
JCS Internet Solutions reserves the right to terminate hosting agreements should the client be found to be hosting illegal, abusive or unsuitable content.
We will determine what constitutes unsuitable content.
No unauthorized access to JCS Internet Solutions servers, mail bombing, or other means of deliberately overloading systems is permitted. System Abuse - Includes, but is not limited to, excessive use of CPU resources or disk space, installing IRC bots, CGI scripts sharing with domains outside of JCS Internet Solutions, or other CGI scripts that use a disproportionate amount of system resources.
We will determine what constitutes system abuse.
UPTIME OF SERVICES
We guarantee that we would do anything in our power to supply a 100% uptime rate
We however can not guarantee that our services will be uninterrupted and will not be held liable for any claims resulting from the use or the inability to use of our Services resulting from or caused by any third party.
We may if necessary and without notice suspend the services in any of the following circumstances
During any technical failure, modification or maintenance either of the service or the equipment by means of which the service is provided.
If the customer fails to comply with any of the terms and conditions of this agreement. (including failure to pay any charges due)
During suspension of service, the customer shall remain liable for all charges due hereunder throughout the period of suspension unless JCS Internet Solutions, in its sole discretion, determines otherwise.
We do not accept liability nor responsibility for Domain names which are lost or have expired due to non-renewal or non payment by the Client.
We are not responsible for website management or files lost or damaged by users.
Website construction and management is the responsibility of the client unless constructed and maintained by agreement in writing between JCS Internet Solutions and the client.
We do backup our servers regularly, however, Client-maintained backups of all site files is recommended, and should be maintained outside our network.
TECHNICAL SERVICES AND DATA RECOVERY
All callouts, technical services and data recovering can be provided and charged for at a hourly flat rate.
Clients will not be aloud to send bulk email classified as unsolicited or spam email.
Emails containing virus or offensive content may cause the client to be in breach and accounts will be suspended.
Domain Registrations
Free domain transfers on selected domains will be charged for if the hosting service is cancelled before the agreed hosting period has expired. Pointed domains do not qualify for free transfer.
Domain name transfers and registration to be billed according to schedule.
Domain names need to be renewed as per schedule. Clients are responsible for payments depending on Hosting agreement.
Web Design
50% Deposit must be paid on approval of a quotation before work will begin. After completion the balance of the fees agreed on to be paid in accordance to the agreement.
REVISIONS AND ALTERATIONS – New work requested by CLIENT and performed by DESIGNER after a proposal/estimate has been approved is considered a revision or alteration. Alterations or redesigns to be billed separately.
Hosting
Clients - The monthly hosting fees are payable in advance by the 10th day of each month. Clients who default on payments will have their services suspended.
Resellers who default on payments will have their access to servers and their clients services suspended.
Accounts past due are subject to penalty interest at the discretion of management and may be subject to cancellation which may result in Data loss.
PAYMENT OF SERVICES
We charge for our services in advance.
Services are only delivered on full payment as stipulated.
REFUNDS
Refund will only be allocated @ management own discretion and if the client are not in breach of the agreement.
Unpaid or returned Debit orders will result in a penalty fee.
We may depending on our agreement only issue invoices and statements on request or on receipt of payment. JCS Internet Solutions are not a VAT vendor, so all prices are excluded.
TERMINATION OF SERVICE AGREEMENT
THE CLIENT may terminate this agreement at any time depending on the original agreement by giving one month notice in writing. At the time of termination, THE CLIENT shall be responsible for the entire amount of the most recent statement and any excess usage charges up to the end of one calendar month.
